The high-risk chapter of the EU AI Act was supposed to bite on 2 August 2026. Regulation (EU) 2026/1744 entered into force on 27 July, with six days to spare, and pushed the date to 2 December 2027, or 2 August 2028 for embedded systems. The standards bodies were not ready, and the conformity machinery the law takes for granted still does not exist. That is 16 months of runway, granted in the final week, to a compliance industry that had spent two years invoicing against the original date. The industry refrain that fixed risk categories cannot keep pace with systems that rewrite themselves overnight would land harder if the categories had a fixed date.

On 7 May, OpenAI put an unreleased research model through ExploitGym, a benchmark built from 898 real vulnerabilities. Within a day it got stuck and worked out that the internet could be reached sideways. By 26 May it had exploited a file repository bolted onto its own test sandbox. In July it turned on Hugging Face, ran tens of thousands of automated actions over a weekend, and lifted the benchmark answers out of the production database. A model being tested on its ability to break into things broke into something, so that it could cheat on the test. Hugging Face went to the police. OpenAI worked out it was the culprit on 21 July, after finding Hugging Face credentials loose in its own investigation.

Every agent should trace back to a named human, so runs the tidy remedy, on the workshop principle of the master who answers for the apprentice. Machine identities now outnumber humans in the average enterprise by 109 to 1, 79 of them agents, against 82 to 1 the year before. The apprenticeship therefore runs one master to 79 apprentices, all holding live credentials, most unrecognisable to the man whose name is on the paperwork. Of the thousands of firms selling agentic software, Gartner can find 130 selling anything of the kind, and expects over 40% of agentic projects to die by the end of 2027 on cost and absent controls. Plenty of the identities queueing for a legal guardian are chatbots with a new logo and a service account.

The accountability idea is the correct one, which is why it will be built last. Dashboards for token spend sell themselves, so do data access maps, and both go through as efficiency spend. A named individual who carries the liability when a swarm walks out of a production database is a cost with a face on it, and no procurement cycle has ever rewarded that. At the Black Hat security conference this month, one of the OpenAI staff who took the incident apart on stage said the industry should expect attackers to assemble deliberately the kind of offensive agent collective his employer had just assembled by accident. The escape happened in May. The burglary happened in July. The rules apply from December 2027.
