Tenants stay, payments don’t.
The most heavily software-locked object in the American economy turned out to be a tractor, and the people who picked the lock were farmers, who have a lobby, a century of fixing things themselves and no patience. On 8 July the Federal Trade Commission and five states settled with Deere: for the next 10 years, farmers and independent workshops get the same diagnostic tools as authorised dealers, including clearing fault codes, pairing newly fitted electronic parts, and restarting a machine stuck in limp mode. A separate class action put $99M into a fund for anyone who paid a dealer for a repair since January 2018. Six states brought consumer electronics repair laws into force on 1 January, and Oregon and Colorado banned parts pairing outright.
Nobody has done this for the bicycle. VanMoof failed on 17 July 2023 with 190,000 riders on the road, more than $180M raised and losses of roughly €78M in each of its final two years. The bikes could not be unlocked, because unlocking was a server. The rescue came from a competitor: Cowboy wrote an app so that VanMoof owners could generate their own digital key. Cowboy has since been swallowed by a French group currently being evicted from its assembly plant for unpaid rent, whose previous acquisition, Angell, arrived with 2,800 owners of frames that crack and a €10M recall nobody could fund. Continuity planning in this sector means hoping the next company down the road feels generous.
Brussels applies its repair directive from Friday. Annex II runs to washing machines, refrigerators, electronic displays, vacuum cleaners, welding equipment, servers, phones and tablets. Bicycles are absent, because the list is pegged to products already carrying reparability requirements under Ecodesign rules, and the connected bicycle carries none. From 31 July a European consumer acquires the right to have a vacuum cleaner mended at a reasonable price, and no right at all over the €3,000 machine that stops working when somebody in another country turns off a server.
The lock has a defence, and it deserves stating. A bicycle that any workshop can reflash is a bicycle that can be derestricted well past 25 km/h, and the manufacturer carries the liability when it hits a pedestrian. Battery fires are not a thought experiment either. Sealing the firmware is a rational answer to a genuine exposure. It simply stops being an answer on the day the manufacturer ceases to exist, at which point the liability belongs to nobody and the hardware belongs to nobody useful. The bicycle was the one machine built to outlast everyone who touched it, the thing a 15 year old could fix with a spanner in a shed, and a frame from 1950 still rides perfectly well. 190,000 people discovered that theirs came with counterparty risk.
