Michael Kratsios, the White House science and technology chief, spent Wednesday on X announcing that Moonshot AI had distilled Anthropic's Fable model into Kimi K3 via a platform built to dodge detection. Scott Bessent followed within hours: sanctions on the table, Entity List on the table, and a line he plainly enjoyed about open source not being open season on American IP. An industry that built itself by swallowing, without asking, roughly everything the species ever wrote down now demands Treasury protection against the indignity of being read. The demand arrived 48 hours after a San Francisco judge approved the largest copyright recovery in history: $1.5B from Anthropic, for 482,460 books it never bought.

The sequence runs one way. First the platforms drained 25 years of personal data, which produced fines in Brussels and shrugs in Washington. Then the models drained the written output of humanity, which produced a $3K cheque per author. Now the models, built entirely out of other people's work, have become the raw material for the next round of extraction. The predator is being farmed, and only now does the state reach for the phone. Ingestion was ruled fair use; what sank Anthropic was procurement, 7M volumes lifted from pirate libraries. The offence was never the reading. It was the receipt.

The evidence stays offstage. Bessent's people are reportedly combing Chinese systems for the watermarks of American models, forensic delicacy from firms whose own corpora arrived with the authorship filed off. Kratsios adds that Moonshot trained on GB300 servers routed through Thailand, either a failure of export control or a very good quarter for a freight forwarder in Bangkok. Braden Hancock of the Laude Institute went for the calendar instead: Fable 5 has not existed long enough to distil a 2.8T-parameter model out of it, and K3 topped every Western flagship in Arena's blind coding tests anyway. Distillation yields a cheaper echo, not a winner. The aggravating circumstance being briefed is that Moonshot means to give the weights away on 27 July, for nothing.

If Moonshot really did farm Claude through 24,000 forged accounts, Anthropic's injury is real, and the lab is no plucky victim of empire: Alibaba-backed, valued above $20B in May, now negotiating at $31.5B. Fraud is fraud. But watch what the state calls it. As long as the plundered were novelists, illustrators and citizens, the matter stayed private law, settled quietly at $3K a book, less than the advance on a modest debut. The moment the plundered party was a model owned by a company worth $965B, it became national security, Treasury Secretary and Entity List attached. The gesture is identical from the first pirate library to the last forged account. Only the victim has climbed the ladder. Nobody ever drafted sanctions on behalf of a poet.
