India's insurance regulator has put in writing what the trade already knew: the middleman is eating the policy. Over two fiscal years, motor premiums grew 34% while the commissions paid to sell them grew 259%. Health premiums rose 53%; commissions rose 118%. The proposed cure is a hard cap on commissions and a five-year squeeze on what insurers may spend. PB Fintech, parent of Policybazaar and the country's largest listed comparison site, lost 36% and $3.3B of market value in one session. Then the buyers arrived. Margin borrowing on the stock tripled in a session to $17M, the largest one-day addition on record, for a firm whose main product had just been declared overpriced by its own supervisor. Policybazaar sells cover against fire, theft and hospital bills. Cover against buying Policybazaar with someone else's money is not yet in the catalogue.

India's markets regulator, SEBI, has been staging this play for two years. After it found that 91% of retail derivatives traders lost money, about $12B of it in a single year, it strangled weekly options and made premiums payable upfront. Speculation did what water does under a closed tap and found the next pipe. Broker-funded margin books have grown from roughly $3B three years ago to more than $16B this summer, up 65% in a year in which the index lost ground. Half of that money sits in small caps nobody can sell when it matters, at up to 5x leverage and double-digit interest.

The insurance regulator has a point. A 10% trim of commissions costs the firm perhaps 12% of earnings; the market removed 36%, pricing the precedent rather than the cap. A commission that triples while the premium it rides on grows by a third has stopped being distribution and become a toll booth with a marketing budget. London banned commissions on investment advice in 2013; Brussels floated a full ban a decade later and quietly shelved it once the industry explained how sad that would make it. But two supervisors of the same citizen have reached opposite verdicts about him. One says a broker should not take more than 15% of his first health premium. The other lets a broker lend him 4x his savings to bet on the firm collecting that commission. The two founders had sold about $75M of their own stock in late spring. Four months later it looks like the only well-timed trade in the story.

The policyholder the cap is meant to protect and the margin trader it just minted are the same person, a salaried thirty-something with two apps on his phone. The average derivatives loser gave up about $1.2K in the last year the regulator measured, roughly four years of family health cover. The cap, if it survives the lobbying, may save him a few thousand rupees a year. The margin loan put several years of that saving back at risk before the next close. The regulator drafted him a safeguard. He read it on the screen he had just used to borrow against it.
